These terms govern your use of markedbykindness.com and any purchase of custom engraved memorials from Marked by Kindness ("we", "us", "our"). By placing an order or using our site, you agree to these terms.

Custom work & approvals

Every piece is engraved by hand for one specific companion. Before engraving begins, we send you a proof showing exactly what will be engraved — spelling, dates, and layout. Nothing is engraved until you approve the proof in writing. Once approved, the engraving is final.

Please review your proof carefully. We are not responsible for errors that match your approved proof.

Pricing & payment

• All prices are listed in US dollars and include applicable taxes unless stated otherwise
• Payment is processed securely through Stripe at checkout
• We reserve the right to refuse or cancel any order before engraving begins

Shipping

Production time varies by product and is shown on each listing. Shipping estimates are provided at checkout. We are not responsible for carrier delays, customs holds, or incorrect shipping addresses provided by the customer.

Returns & refunds

Because each piece is custom-engraved, personalized items cannot be returned or exchanged once engraved. However, we will replace or refund at no cost if the item arrives damaged, contains an engraving error that doesn't match your approved proof, is defective, or never arrives. Photos & content you provide

When you upload a photo or share a companion's story, you grant us permission to use it only to create your order. We will not use your photos, names, or stories for marketing without your explicit written consent.

Intellectual property

All content on this site — text, images, designs, logos — is owned by Marked by Kindness. You may not reproduce, copy, or distribute our content without permission.

Limitation of liability

Our liability is limited to the purchase price of your order. We are not liable for indirect, incidental, or consequential damages arising from the use of our products or site.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Disputes will be resolved in the courts of California.

Changes to these terms

We may update these terms from time to time. The date above reflects the last revision. Continued use of our site after changes constitutes acceptance.
